Terms of Use

Please read these Terms of Use ("Terms") carefully before using Audior Desktop ("the Application"). By installing or using the Application, you agree to be bound by these Terms.
1. License Grant
Subject to these Terms and payment of applicable license fees, Creatiwi AI grants you a limited, non-exclusive, non-transferable, revocable license to install and use the Application on devices you own or control, solely for your personal or internal business purposes.
2. License Restrictions
You may not:
- Copy, modify, or distribute the Application
- Reverse engineer, decompile, or disassemble the Application
- Rent, lease, lend, sell, sublicense, or transfer the Application to any third party
- Remove or alter any proprietary notices, labels, or marks on the Application
- Use the Application to develop competing products
3. Open Source Components
The Application uses @audior/core and other open-source libraries. These components are licensed under their respective open-source licenses (primarily MIT License) and are not subject to these Terms. You may use those components in accordance with their licenses. See the Audior repository for details.
4. Third-Party Services
The Application integrates with third-party services including but not limited to:
- Google Gemini API (OCR)
- ElevenLabs (text-to-speech)
- Resemble AI (text-to-speech)
- Audiobookshelf, Plex, Calibre (media servers)
Your use of these services is governed by their respective terms and privacy policies. Creatiwi AI is not responsible for the availability, accuracy, or conduct of third-party services. We do not control, endorse, or accept liability for any third-party service.
5. No Data Collection
Creatiwi AI does not collect, process, store, or transmit any of your personal data, project content, or API keys. All data remains on your device or is transmitted directly from your device to third-party services you choose to use.
6. API Keys and Costs
You are solely responsible for:
- Obtaining and managing your own API keys from third-party providers
- Any costs incurred from your use of third-party APIs
- Compliance with each provider's terms of service and acceptable use policies
7. Content Responsibility
You are responsible for ensuring you have the necessary rights to any content you process using the Application, including but not limited to:
- Book pages, documents, or images submitted for OCR
- Voice samples used for voice cloning
- Text converted to speech
The Application is a tool. Creatiwi AI makes no claims about content ownership or copyright status of materials you process.
8. Disclaimer of Warranties
THE APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
Creatiwi AI does not warrant that:
- The Application will meet your requirements
- The Application will be uninterrupted, timely, secure, or error-free
- The results obtained from the Application will be accurate or reliable
- Any errors in the Application will be corrected
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CREATIWI AI BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
- Your use or inability to use the Application
- Any unauthorized access to or use of our servers or any personal information
- Any third-party service integrated with the Application
- Any errors, mistakes, or inaccuracies of content
- Any other matter relating to the Application
10. Updates to Terms
We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date. Your continued use of the Application after changes constitutes acceptance of the updated Terms.
11. Termination
We may terminate or suspend your license immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, you must cease all use of the Application and destroy all copies.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of Poland, without regard to its conflict of law provisions. For EU consumers, mandatory consumer protection laws of your country of residence will apply.
13. Dispute Resolution
Any disputes arising from these Terms shall be resolved through good faith negotiations. If negotiations fail, disputes shall be submitted to the courts of competent jurisdiction in Poland. EU consumers may also use the EU Online Dispute Resolution platform.
